Privacy policy

ACTIEF INSURANCES NV (hereinafter the “Firm”) takes your rights in relation to data processing seriously. This document explains how we collect, process and use your personal data. It constitutes the general data processing policy of the Firm in accordance with the applicable legislation including the General Data Protection Regulation (GDPR).

As an insurance broker, the Firm may have a dual role in data processing. In this case, we are both a controller and a processor. We assume the role of data controller when we process data in our own name and on our own behalf. In addition, we also fulfil the role of processor on behalf of the insurance companies. This means that we also collect and process personal data for the insurance companies with whom we cooperate and from whom we present and offer products to you. In this declaration, we will only elaborate on the processing of your data as a controller.

When does our firm collect and process data?

The firm collects and processes data about you when you contact us for the purpose of advice on insurance contracts, offering or proposing insurance contracts, carrying out preparatory work for the conclusion of insurance contracts and the conclusion itself of insurance contracts. In addition, you can also call on us or contact us for assistance in the management and implementation of the insurance contracts you have concluded. We will also process your data if you contact us in any other way. Finally, it is also possible that we obtain data about you from third parties and use this data to approach you in order to conclude a contract through our mediation.

 

What data does our firm collect and process?

The firm collects and processes data that you provide to us as a result of contact with the firm, such as your name, address, e-mail address and professional data, such as company name and VAT number. It also includes all data necessary to allow us to assess your insurance needs. This includes data concerning your home (in connection with fire insurance), your financial data (in connection with investment insurance) and medical data (in connection with health insurance). Your data will only be processed within the framework of the insurance you take out with us, unless you decide otherwise and indicate this accordingly.

We collect this data when you fill in our documents and forms manually and also when you do so electronically. Cookies are used when visiting our website. For more information, please contact the firm.

 

For what purposes does our firm collect and process data?

The purposes for which we process data are diverse and are set out below.

For our clients, we process this data for customer management purposes, in particular the acceptance, management and conclusion of insurance contracts and the promotion of other products and services offered by our firm. These processing operations are primarily based on the contractual relationship with our customers, but also, as far as prospecting is concerned, on your express consent.

In relation to suppliers, we process this data within the framework of our supplier management and on the basis of the contractual relationship we have or are building with our suppliers.

As far as prospects are concerned, which are natural persons who are not (yet) our customers, we process the data for direct marketing purposes, based on our legitimate business interests. We ask prospective customers who are contacted by email for their express permission to be contacted in the future. Prospects who are approached by letter are requested to tick an opt-out clause if they do not wish to be contacted further by us.

For our employees, we process the data for purposes such as personnel management and payroll administration.

With regard to our website, the content and ease of use is tailored to you, the users, where possible. We also process your data to fulfil the obligations stemming from the provision of a website and its content and to enable you to use the interactive applications and services on this website.

 

What are the bases for the processing of data by our firm?

In principle, we collect and process your data on the basis of the contractual relationship that we have with you as a result of your application or request in connection with an insurance requirement and the resulting contract(s), as well as the request to assist you in the management and follow-up of the insurance contracts that you have concluded.

Where the processing is not necessary in the context of the contractual relationship, it is based on our legitimate interests as a company, in particular the freedom of enterprise and information. In doing so, we always ensure that a balance exists between our interests and yours, for example, by granting you a right to object.

As far as medical data or so-called sensitive data are concerned, we can only process your personal data with your explicit consent. You will be asked for this when you become a customer. If this is not the case, please inform us so we can take the necessary action.

 

Will the data be disclosed to third parties?

Your data will mainly be processed internally. However, they must be communicated to the insurance company with whom you ultimately conclude the contract.

It is possible that we call on third parties for certain punctual services. In such cases, your data may be transmitted to these third parties but only for the purpose of the service in question and always under the control of our firm.

In certain cases, there is a legal obligation to transfer certain data. This is particularly the case if we are legally obliged to do so or if public authorities have the right to request data from us.

Your data will in principle not be transferred to third countries or international organisations.

 

Your rights

The regulation grants you various rights to ensure that you are adequately protected.

You can always object free of charge against the use of your data by our firm for marketing direct purposes. If you do not wish to be kept informed about offers, you can report this via  privacyoffice@actiefinsurances.be or by ticking a box in the information provided to you on specific occasions.

You can always check the data we process about you and, if necessary, have it corrected. To do this, simply request it at  privacyoffice@actiefinsurances.be, with proof of your identity. We ask this in order to prevent your data from being disclosed to anyone who is not entitled to it.

If you do not agree with the way in which we process your data, you can always lodge a complaint with the Data Protection Authority, Drukpersstraat 35, 1000 Brussels. You can also contact them for any general questions relating to the processing and protection of personal data.

 

Changes

Our firm reserves the right to amend this declaration. Changes will be notified to users via the website.
